1、ChatGPT会颠覆知识产权行业吗？

ChatGTP可以为知识产权行业的某些场景赋能，至于赋能有多么强力，要看ChatGPT的技术到底有多么智能，以及应用者在何种场景、如何训练ChatGPT。

举几个专利领域的例子:

第一、是已经有人讨论过的使用ChatGPT写专利的场景。我个人认为，ChatGPT肯定可以用于写专利，但是，如果借用现在的高价值专利这一热词，作者持高度怀疑和谨慎观点。对于写专利，将ChatGPT视为现有的“编专利软件或平台”的高级升级版，并无不妥，因为真正的高价值专利，需要考虑的前台后台因素实在是太多，而且很多是不确定、甚至是未知的！（The name of the game is Claim.）

第二、ChatGPT对于专利挖掘可以提供帮助。相比于很多搜索以及交互算法和技术，ChatGPT肯定具有技术层面的极大改进，这一点，归结到底，其实就是信息（现有技术）的搜索和消化能力，这一能力，对于专利（创新点）挖掘显然具有最直接的帮助。此外，如果我们将这一点稍微扩展一下，就可以看到ChatGPT能够为技术研发带来的帮助。

第三、如果能够理解ChatGPT在专利挖掘领域的应用，那么，对于专利人士而言，ChatGPT在专利纠纷处理（尤其是专利无效）领域的应用则应当是顺其自然就可以想到的。

第四、继续关联性延伸，ChatGPT应该可以在专利维权领域起到作用，例如发现侵权。

第五、其他本质上是专利信息/情报利用的应用场景，例如专利分析、导航、评议、FTO等，ChatGPT都可以提供效率提升、成本节约视角的有益帮助。

小结一下，笔者认为，在专利撰写领域，不能太过倚赖ChatGPT提供赋能作用外，在专利挖掘、专利无效和发现侵权等领域，ChatGPT应该能提供较大增幅的赋能提升，在专利分析、导航、评议、FTO以及等价值评估、交易设计与谈判等领域，ChatGPT应该可以提供效率提升、成本节约视角的有益帮助，但取决于具体的需求场景，同样不能过分倚赖ChatGPT的输出结果。

如果没有下面的事情发生，笔者认为，ChatGPT是不会颠覆（覆灭）知识产权（专利）行业的！

2、ChatGPT可以颠覆知识产权（专利）行业！

持续了两三年的AI是否可以作为发明人的争议，显然仅仅是限制了人们的想象，AI对于专利行业的挑战，仅被限制在现有专利制度的框架下，AI做出的发明创造该如何被认定的小范围内（AI是否可以作为发明人，仅此而已）。

作者认为，如果现有的专利制度框架不做出重大乃至本质性改变，那么ChatGPT完全有颠覆或覆灭专利行业的可能，怎么做到？其实很简单，就是让世界上不存在符合专利授权条件的发明创造 - 由于新颖性、创造性问题，导致无法被授权。

试想一下，ChatGPT是可以永不停歇的、持续产出覆盖任何技术领域的现有技术（Prior Arts）的，如果这些现有技术都成为公众可以获悉的（Publicly Available），那么还有哪个发明创造可以获得授权呢？

这就是ChatGPT可以直接导致专利行业颠覆、覆灭的地方！

现在还没有发生，是因为ChatGPT还没有被“操纵”用于该目的！（暂时点到此为此，更多内容不再展开...可以从多个维度观察、讨论与决策）
